This significant ruling was delivered by Senior Resident Magistrate David Odhiambo, who presided over the case. With unwavering conviction, the magistrate affirmed that the prosecution, led by PC Barbara Sombo, had conclusively established the three crucial elements of the case: the victim’s age, the act of penetration, and the unequivocal identification of the accused as the perpetrator of this reprehensible crime.
The Office of the Director of Public Prosecutions (ODPP) issued a statement, announcing the conviction of Mwarabu Omar Pato. The statement highlighted the magistrate’s decisive judgment and the prosecution’s unassailable case. It read, “Mwarabu Omar Pato was convicted by Senior Resident Magistrate David Odhiambo, who ruled that the prosecution, through PC Barbara Sombo, had proven its case beyond reasonable doubt by demonstrating the three essential aspects of the case: the age of the minor, penetration, and positive identification of the accused in the defilement case.”
Magistrate Odhiambo further emphasized the irrefutable nature of the evidence presented during the trial, which included crucial documents such as the Post-Rape Care (PRC) and P3 forms. These documents left no room for doubt, as they unequivocally confirmed the defilement of the young victim.
This appalling offense took place on November 14, 2022, casting a dark shadow over the Mikanjuni area of Jomvu Sub-county, Mombasa County.
