Former Kiambu Governor Ferdinand Waititu wants the court to declare his impeachment invalid and void.
Waititu moved to court trying to regain control of Kiambu County two years after he was impeached over gross misconduct and abuse of office.
Through his legal counselors Wildred Nyamu and Charles Njenga, Waititu requested that the High Court kick Governor James Nyoro out of office and reestablish him (Waititu) as the county boss.
He contended that his impeachment process was unlawful and an infringement of the constitution by the Kiambu County Assembly. As per him, the county assembly didn’t follow the fair treatment to ouster him.
Judges George Dulu, Grace Nzioka and Wildrida Okwany heard that the MCAs didn’t meet the majority during Waititu’s impoeachment. There were just 57 MCAs present in the House during the said process, Waititu’s lawyers said
“Six of the MCAs were in Dubai, two were absent without apology, three were away in UAE while 30 were absent,” Nyamu said.
Since the passage of the arraignment process was illegal, as per him, he wants the court to declare Governor Nyoro’s swearing as an infringement of the constitution thus null and void.
“The petitioner has a right to get back to his office as if he was never removed. There was no impeachment,” the lawyer said.
Nyamu further contended that Waititu was peoples choice and ought not have been unlawfully taken out of office.
