In a virtual testimony from his hospital bed, DJ Evolve, whose real name is Felix Orinda, stated to the Milimani court that he did not witness Embakasi East MP Babu Owino shooting him.
During the proceedings, defense lawyer Duncan Okatch asked DJ Evolve, “Did you see Babu Owino with a gun?” to which he replied, “No, we were just having conversations with Mr. Owino, and the next thing I knew, I was in an ambulance on my way to the hospital.”
DJ Evolve, guided by defense lawyer Okatch, disclosed that Mr. Owino had been his personal friend since 2017.
When asked if he knew what had transpired, DJ Evolve admitted that he did not have any knowledge of the events that unfolded.
He further informed the court that following the incident, Mr. Owino was the sole person who provided assistance for his well-being, including covering his hospital bills and other personal expenses.
The DJ emphasized that there was no disturbance prior to the shooting and that the lights at B Club had been dimmed.
Additionally, DJ Evolve clarified that he was not coerced into testifying on Mr. Owino’s behalf.
Supporting DJ Evolve’s account, Mr. Owino’s bodyguard, Edwin Gedi Otieno, stated that Mr. Owino had deposited his gun and nine rounds of ammunition in the club’s armory. The gun was entrusted to Charles Ochieng, the armory keeper.
Gerdi, the bodyguard, informed the magistrate that Mr. Owino’s gun was unable to fire as it had malfunctioned at the Ngong shooting range on January 15, 2020.
An earlier examination by a ballistics expert confirmed that the gun was inoperable.
The armory keeper testified that he had safeguarded Mr. Owino’s gun until 7 a.m. on January 17, 2020, when he handed it over to the MP.
Mr. Otieno also informed the court that he accompanied the MP to the van transporting the injured DJ to the hospital.
