A 17 years old boy from Murang’a County who impregnated his cousin when they were both 14 years of age has lost his appeal in Murang’a high court.
In the court reports, the boy is accused to have defiled a 14 years girl on December 2017 at his parent’s home in Kangema.
The said boy has been jailed for 9 months followed by 2 years probation.The young man in the appeal which he presented on February 1,2021, contended that he was being segregated since his cousin was not accused of a similar offense. He additionally, claimed the trial was defective for failing to order an assessment of his age contrary to the law on children’s act.
However Judge Kanyi Kimondo,disagreed with the boy and said he he ordered the prosecution to produce a birth certificate of the boy.
On the girls side, she had told the police that she forced her into sex, however when she stood up she affirmed that they had an arrangement, and she had said that before to mollify her mom.
The young lady after a couple of months conceived , but the child passed erasing any proof that the boy was the biological father as per the judge said.
The Judge however subbed the 2 years for probation as ordered by the lower court and placed a 1 year probation in Nairobi
